Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Drydown ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Drydown is a personal fragrance collection management application that provides AI-powered identification, recommendations, layering suggestions, and wear tracking. The App is available for iOS and Android devices and offers both free and premium (Pro) features.

3. User Accounts

Drydown does not require user accounts. The App stores data locally on your device and optionally syncs via cloud backup (iCloud on iOS, Google Drive on Android). We do not maintain user databases or authentication systems.

4. In-App Purchases and Subscriptions

4.1 Drydown Pro

The App offers a premium subscription ("Drydown Pro") that unlocks additional features. Subscriptions are available on a monthly or annual basis.

4.2 Payment

All payments are processed through your platform's app store (Apple App Store or Google Play). By subscribing, you agree to Apple's payment terms and conditions.

4.3 Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions in your device's account settings.

4.4 Free Trial

If a free trial is offered, it will automatically convert to a paid subscription at the end of the trial period unless cancelled beforehand.

4.5 Refunds

Refund requests are handled by Apple in accordance with their App Store refund policies. Contact Apple Support for refund inquiries.

5. AI-Powered Features

The App provides AI-powered features through two methods:

5.1 Drydown Proxy Service (Default)

By default, AI features are routed through a proxy service we operate. By using these features:

• You acknowledge that fragrance-related queries and photos are forwarded to third-party AI providers for processing
• You agree that AI-generated results are for informational purposes only
• Usage is subject to fair-use rate limits

5.2 Bring Your Own Key (Optional)

You may optionally provide your own API keys for third-party AI services (Google Gemini, OpenAI). By using these features:

• You agree to the terms of service of the respective API provider
• You are responsible for any charges incurred through your API usage
• You acknowledge that data sent to these services is subject to their privacy policies
• We are not responsible for the availability, accuracy, or conduct of third-party AI services

6. Acceptable Use

You agree to use the App only for its intended purpose of managing your personal fragrance collection. You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Use the App for any commercial resale purpose
• Attempt to gain unauthorized access to any systems connected to the App
• Use the App in any way that violates applicable laws or regulations

7. Intellectual Property

The App, including its design, code, graphics, and content, is protected by copyright and intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App on your personal devices.

8. Data and Privacy

Your use of the App is also governed by our Privacy Policy. Your fragrance data remains on your device and in your private cloud storage. We do not access, collect, or store your personal data on our servers.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• The App will be uninterrupted or error-free
• AI-generated recommendations, identifications, or suggestions will be accurate
• The App will meet your specific requirements
• Any defects will be corrected

Fragrance identification, recommendations, and valuations are provided for informational purposes only and should not be relied upon as expert appraisals.

10. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or goodwill, arising from your use of the App.

11. Platform EULAs

This App is licensed to you under the standard End User License Agreement (EULA) of the platform through which you obtained it (Apple App Store or Google Play). In the event of a conflict between these Terms and the platform EULA, the platform EULA shall take precedence.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting the updated Terms. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
